General part

1. This Procedure regulates the issue of the formation of a one-time specialized academic council of a higher education institution, a scientific institution (hereinafter referred to as the institution) and its awarding of the degree of Doctor of Philosophy, as well as the cancellation of the decision of the one-time specialized academic council on awarding the specified degree.

2. In this Order, the terms are used in the following sense:

attestation of the recipient of the degree of Doctor of Philosophy (hereinafter referred to as the attestation of the recipient) — determination by a one-time specialized academic council as a result of the successful completion by the recipient of the degree of Doctor of Philosophy of the educational and scientific program and his public defense of his dissertation that the results of his scientific work meet the requirements of the educational and scientific program;

the head of the one-time specialized academic council (hereinafter referred to as the head of the one-time council) is a person who, by his main place of work, works as a scientific-pedagogical or scientific employee of the institution in which the one-time specialized academic council was formed, has a scientific degree of Doctor of Sciences and is a competent scientist in the subject of the applicant's research degree of doctor of philosophy;

dissertation of the recipient of the degree of Doctor of Philosophy (hereinafter referred to as "dissertation") - a qualifying scientific work, which is completed by the recipient of the degree of Doctor of Philosophy personally, contains the scientific results of the research conducted by him and is submitted for the purpose of awarding him the degree of Doctor of Philosophy;

recipient of the degree of Doctor of Philosophy (hereinafter referred to as the recipient) is a person who completes an educational-scientific program at the third (educational-scientific) level of higher education at the institution with the aim of obtaining the degree of Doctor of Philosophy;

the information system of the National Agency for Quality Assurance of Higher Education (hereinafter - the information system) is an electronic information and communication system administered by the National Agency for Quality Assurance of Higher Education (hereinafter - the National Agency) and makes it possible to create, view, and exchange information in electronic form regarding formation of one-time specialized academic councils, awarding by them the degree of doctor of philosophy and cancellation of decisions of one-time specialized academic councils on awarding the specified degree. The national agency establishes the procedure for the functioning of the information system, which should provide for the functional capabilities of the information system, the components of the information system and the mechanism of their functioning, the list of information to be entered into the information system, the procedure for authentication;

official opponent - a person who is a scientific-pedagogical or scientific employee and does not work in an institution in which a one-time specialized academic council has been formed, has a scientific degree and is a competent scientist in the subject of the applicant's research;

one-time specialized academic council (hereinafter - one-time council) - specialized academic council, which is formed by an institution with the right to accept for consideration and conduct a one-time defense of the candidate's dissertation for the purpose of awarding him the degree of doctor of philosophy;

reviewer - a person who, by his main place of work, works as a scientific-pedagogical or scientific employee of the institution in which the one-time council is formed, has a scientific degree and is a competent scientist in the subject of the applicant's research;

the subject of research is part of the subject (disciplinary) area of the specialty (specialities), within which intellectual creative activity is carried out, aimed at obtaining and using new knowledge and in which scientific results are published.

The terms "relatives", "real conflict of interest" and "potential conflict of interest" are used in the meaning given in the Law of Ukraine "On Prevention of Corruption".

3. The one-time board is formed by the institution in which the applicant completed an accredited educational and scientific program.

A student who is completing an unaccredited educational and scientific program has the right, in accordance with the procedure established by law, to be transferred to another institution that has an accredited educational and scientific program in the relevant specialty (specialities).

4. If the applicant has completed an accredited educational and scientific program, the individual elements of which are provided by another institution, a one-time council is formed in the institution where it was carried out, with the possible involvement as a reviewer of a person who works as a scientific-pedagogical or scientific employee of the institution at the main place of work, which provided certain elements of the educational and scientific program, subject to compliance with other requirements for the reviewer established by this Procedure.

In the case when the training of the applicant was carried out according to an accredited educational and scientific program in accordance with the contract between domestic and foreign institutions, a one-time council can be formed on the basis of one of the specified institutions. In the event that a one-time board is formed on the basis of a domestic institution, the formation of such a board is carried out in accordance with this Procedure. An employee of a foreign institution that was a party to the specified contract may be a reviewer provided that other requirements for reviewers established by this Procedure are met. In case of attestation of the applicant in a foreign institution, a one-time council is formed in accordance with the legislation of the foreign state.

Awarding the degree of Doctor of Philosophy

5. The applicant must acquire theoretical knowledge, abilities, skills and competences determined by the standard of higher education of the third (educational-scientific) level in the relevant specialty, conduct his own scientific research in the form of a dissertation, and publish his main scientific results.

In the absence of a corresponding standard of higher education, the requirements for the level of knowledge, skills and abilities are determined in accordance with the eighth level of the National Qualifications Framework, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 23, 2011 No. 1341 (Official Gazette of Ukraine, 2011, No. 101, Art. 3700; 2020, No. 54, Article 1670).

6. The dissertation must contain new scientifically based results of studies carried out by the applicant, which perform a specific scientific task, which is of significant importance for a certain field of knowledge.

The dissertation is written in the state language or in English.

The requirements for the preparation of the dissertation are established by the Ministry of Education and Culture. The maximum and/or minimum volume of the main text of the dissertation is established by the educational and scientific program of the institution in accordance with the specifics of the relevant field of knowledge and/or specialty.

7. The dissertation is submitted for defense in the form of a specially prepared manuscript.

8. The scientific results of the dissertation must be covered in at least three scientific publications of the applicant, which include:

1) articles in scientific publications included on the date of publication in the list of specialized scientific publications of Ukraine. If the number of co-authors in such an article (together with the recipient) is more than two people, such an article is equal to 0.5 publications (except for the publications specified in subparagraph 2 of this clause);

2) articles in periodical scientific publications indexed in the Web of Science Core Collection and/or Scopus databases (except for publications of a state recognized by the Verkhovna Rada of Ukraine as an aggressor state);

3) no more than one patent for an invention that has passed the qualification examination and is directly related to the scientific results of the dissertation, which is equivalent to one scientific publication;

4) one-person monographs recommended for publication by academic councils of institutions and passed peer review, except for one-person monographs published in a state recognized by the Verkhovna Rada of Ukraine as an aggressor state. Individual chapters in collective monographs are equated to individual monographs under the same conditions.

An article in a publication assigned to the first to third quartiles
(Q1-Q3) according to the classification of SCImago Journal and Country Rank or Journal Citation Reports, or an individual monograph that meets the specified requirements, is equated to two scientific publications.

The belonging of a scientific publication to the first — third quartiles
(Q1—Q3) according to the SCImago Journal and Country Rank or Journal Citation Reports classification is determined according to the rating in the year in which the corresponding publication of the recipient was published or in the case when the rating for the corresponding year is not published on the date of formation of the one-time council, according to the last published rating.

9. Articles are counted according to the topic of the dissertation, provided that the obtained scientific results are substantiated in accordance with the purpose of the article (task) and conclusions, as well as the publication of no more than one article in one issue (issue) of a scientific publication.

Articles published after the entry into force of this Procedure are counted according to the topic of the dissertation only if they have an active DOI identifier (Digital Object Identifier), except for publications containing information classified as a state secret or information for official use.

It is not considered self-plagiarism if the applicant uses his scientific works in the text of the dissertation without reference to these works, if they were previously published with the aim of highlighting the main scientific results of the dissertation and indicated by the applicant in the dissertation abstract.

10. After completing studies under an accredited educational and scientific program, the applicant:

1) receives an academic certificate on the implementation of the educational and scientific program, drawn up according to the form approved by the Ministry of Education and Culture, and the conclusion of the scientific supervisor (supervisors);

2) applies to the structural subdivision of the institution that implements the relevant educational and scientific program and/or prepares the applicant, with a written application to obtain a conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation. The thesis is attached to the application in printed and electronic form, scientific publications (or their copies), which highlight the scientific results of the thesis, an academic certificate on the implementation of the educational and scientific program and the conclusion of the scientific supervisor (supervisors).

11. In order to provide a conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation, a public presentation of the scientific results of the dissertation is held by the recipient and its discussion at a meeting of the structural unit of the institution that implements the relevant educational and scientific program and/or prepares the recipient. The results of the discussion and presentation are reflected in the conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation, which is signed by the chairman at the meeting of the structural unit of the institution.

In the case of receiving a negative conclusion about the scientific novelty, theoretical and practical significance of the results of the dissertation, the applicant retains the right to appeal again to the structural unit of the institution with a written application to receive such a conclusion after finalizing the dissertation or to renew at the institution to complete the relevant educational and scientific program, if the applicant is prematurely withdrawn from postgraduate studies at his own request.

12. In the presence of good reasons (due to health, family circumstances, etc.), the applicant has the right to receive a conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation and conduct a defense of the dissertation in a one-time council within two years after being expelled from graduate school by written application .

13. On the condition of receiving a positive conclusion about the scientific novelty, theoretical and practical significance of the results of the dissertation, the applicant has the right to apply to the academic council of the institution in which he completed the educational and scientific program, with a written application for the formation of a one-time council.

In the application, the applicant certifies that the dissertation was completed by him/her independently in compliance with academic integrity, confirms that the final text of the dissertation has been submitted for defense, and indicates the language of the dissertation defense (state language or, at the request of the applicant, English).

The following are attached to the application:

dissertation in printed and electronic form;

scientific publications (or their copies), which highlight the scientific results of the dissertation;

academic certificate on the implementation of the educational and scientific program;

conclusion of the scientific supervisor (supervisors);

conclusion on scientific novelty, theoretical and practical significance of the results of the dissertation.

14. The academic council no later than two months after receiving the applicant's application forms a one-time council consisting of five people - the head of the one-time council, two reviewers and two official opponents, about which an order of the institution is issued.

The competence of the members of the one-time council on the topic of the recipient's research is determined by the presence of at least three scientific publications on the topic of the recipient's research, provided that they were published within the last five years before the day of the creation of the one-time council and after the awarding of the doctor of philosophy degree (candidate of sciences) to the scientist, which includes:

single-person monographs recommended for publication by academic councils of institutions and reviewed, except for single-person monographs published in a state recognized by the Verkhovna Rada of Ukraine as an aggressor state. Individual chapters in collective monographs are equated to individual monographs under the same conditions (for foreign publications - in accordance with the requirements for scientific publications of the relevant state);

scientific articles published in scientific publications included on the date of publication in the list of specialized scientific publications of Ukraine;

scientific articles published in periodical scientific publications indexed in the Web of Science Core Collection and/or Scopus databases, except for publications of a state recognized by the Verkhovna Rada of Ukraine as an aggressor state.

An individual monograph with a total volume of at least five author pages or a scientific publication in a periodical scientific publication, assigned to the first — third quartiles (Q1—Q3) according to the classification of SCImago Journal and Country Rank or Journal Citation Reports, is equated to two scientific publications.

(Q1—Q3) according to the classification of SCImago Journal and Country Rank or Journal Citation Reports is determined according to the rating in the year in which the corresponding publication of the one-time council member was published or in the case when the rating for the corresponding year is not published on the date of formation of the one-time council, according to the last published rating.

15. The structural division, at the meeting of which a public presentation was made by the recipient of the scientific results of the dissertation, submits proposals to the academic council of the institution regarding candidates for membership of the one-time council.

If the institution does not have the opportunity to appoint two reviewers taking into account the requirements of this Procedure, a one-time council is formed consisting of the chairman of the council, one reviewer and three official opponents.

Official opponents cannot work in the same institution and are included in the one-time board with their written consent.

16. A person cannot be a member of a one-time council if he:

1) is the academic supervisor of the applicant;

2) is the head of the institution in which the one-time council is formed;

3) is a co-author of scientific publications of the recipient;

4) has a real or potential conflict of interest in relation to the recipient (in particular, is a close person of the recipient) and/or his scientific supervisor;

5) was brought to academic responsibility for violation of academic integrity, in particular regarding deprivation of the right to participate in the work of specialized academic councils in accordance with the Laws of Ukraine "On Higher Education", "On Scientific and Scientific and Technical Activities";

6) works (worked) in management positions in institutions, institutions, organizations that illegally conduct (conducted) their activities in the temporarily occupied territories of Ukraine;

7) does not speak the language of the dissertation defense to the extent sufficient for qualified attestation of the applicant;

8) received a doctor of philosophy diploma (candidate of sciences) less than three years before the date of formation of the one-time council.

One person can participate as a member of a one-time council in no more than eight dissertation defenses during a calendar year.

17. The decision on the formation of a one-time council is made by the academic council of the institution. Based on the decision of the academic council, the institution issues an order on the formation of a one-time council.

18. Within five working days from the date of issuance of the order on the formation of a one-time council, the institution:

1) publishes, taking into account the requirements of the legislation on state secrets and official information, on its official website an electronic copy of the dissertation in PDF/A format with a text layer with an overlay of the electronic signature of the applicant based on a qualified electronic signature certificate (using a qualified electronic mark time), and information about the composition of the one-time board, a link to the website where the dissertation defense will be broadcast;

2) enters information about the formation of a one-time council into the information system;

3) transfers a printed copy of the dissertation, signed by the applicant, to the library of the institution;

4) submits an electronic copy of the dissertation to the state scientific institution "Ukrainian Institute of Scientific and Technical Expertise and Information", as well as to the institution's local repository.

19. Information on the formation of a one-time council is considered to be made public from the day it is entered into the information system.

Any person who is a subject of scientific and scientific and technical activity can submit a notification to the Ministry of Education and Culture regarding non-compliance of the composition of the one-time council with the requirements of the law within 15 days from the date of publication by the National Agency of information on the formation of the one-time council (amendments to the composition of the one-time council).

The Ministry of Education and Culture checks the compliance of the composition of the one-time council with the requirements of clauses 14-16 of this Procedure and considers reports regarding the non-compliance of the composition of the one-time council (if received) within a month from the date of publication by the National Agency of information on the formation of the one-time council (amendments to the composition of the one-time council).

In case of detection of violations, the MES stops the work of the one-time council by entering the relevant information into the information system indicating the reasons for eliminating the detected violations.

20. In order to eliminate the detected violations, as well as in the case of the impossibility of the member(s) of the one-time council to fulfill their duties, the institution issues an order to make changes to the composition of the one-time council, information about which is entered into the information system.

21. Information about changes in the composition of the one-time council is made public in the information system.

22. Based on the results of studying the dissertation and scientific publications of the recipient, counted according to the topic of the dissertation, within 45 calendar days from the date of publication of information on the formation of the one-time council, each reviewer submits a review to the one-time council, and each official opponent - a review, in which the results of their own assessment of the scientific level are noted dissertations and scientific publications of the recipient, in particular the novelty of presented theoretical and/or experimental results of research conducted by the recipient, their scientific validity, the level of fulfillment of the scientific task and the mastery of the methodology of scientific activity by the recipient.

Reviewers and official opponents ensure the objectivity of the reviews and feedback prepared by them, certify them with their own signatures and imprints of seals of institutions at the main place of work.

In the event that the review (feedback) does not meet the established requirements, the chairman of the one-time council determines the deadline for its (his) finalization.

In the case of failure to submit a review (feedback) within the established deadline or submission in violation of the established deadline, the chairman of the one-time board initiates the question of replacing the relevant member of the board before the academic board of the institution.

23. The institution ensures the creation of the necessary conditions for the one-time board to check the applicant's compliance with academic integrity.

If academic plagiarism, fabrication, falsification is discovered by members of the council in the applicant's dissertation and/or scientific publications, the reviewer (official opponent) notes this in his review (feedback).

24. Within three working days from the date of receipt of the last review (feedback) to the one-time council:

the one-time council appoints the date, time and place of the public defense of the dissertation. The date of the public defense of the dissertation is set no earlier than two weeks and no later than four weeks from the date of receipt of the last review (feedback) by the one-time council. Information about the date, time and place of public defense of the candidate's dissertation is published on the institution's official website and entered into the information system;

electronic copies of reviews (feedback) in PDF/A format with a text layer overlaying the electronic signature of the reviewer (official opponent), based on a qualified electronic signature certificate (using a qualified electronic time stamp), are published on the official website of the institution, taking into account the requirements legislation on state secrets and official information, and their copies are provided to the acquirer for perusal at the request of the acquirer.

25. The public defense of the dissertation is held at a meeting of the one-time council, which is considered valid if the full membership of the one-time council participates in it.

Members of the one-time council and/or the acquirer can participate in the meeting of the one-time council by means of video communication in real time. The institution provides the possibility of using video communication tools, in particular for persons with disabilities.

In the absence of a quorum for the meeting, the one-time council makes a decision to postpone the date of the dissertation defense, appointing another date no earlier than two weeks and no later than four weeks from the previous date.

Within three working days from the date of the decision to change the date of the dissertation defense, information about the date, time and place of the dissertation defense is published on the institution's official website and entered into the information system.

26. The institution provides a real-time broadcast of the dissertation defense on its official website, as well as a video recording of the dissertation defense broadcast, taking into account the requirements of the legislation on state secrets and official information.

The quality and duration of the video recording of the dissertation defense broadcast must be sufficient to fully (without interruptions) reproduce the dissertation defense procedure, including the speeches of the candidate and members of the one-time board, the scientific discussion, as well as the voting of each of the board members.

27. The meeting of the one-time council for the public defense of the dissertation is held according to the procedure determined by the institution.

During the attestation of the recipient, the members of the one-time council must assess the scientific level of his dissertation and scientific publications, taking into account his compliance with academic integrity, as well as establish the level of the recipient's acquisition of theoretical knowledge, relevant abilities, skills and competencies.

The defense of the dissertation must have the character of an open scientific discussion, in which the applicant, the chairman and all members of the one-time council must participate.

If the institution receives appeals from other persons with an evaluation of the dissertation, the one-time council will announce them during the public defense of the dissertation and, taking into account the results of their consideration, will make an appropriate decision. Such appeals are considered if they are received no later than three working days before the day of the dissertation defense.

28. Each member of the one-time council openly expresses his position in favor of awarding or refusing to award the degree of Doctor of Philosophy.

The Council makes decisions by open voting:

on awarding the degree of Doctor of Philosophy, if it was supported by at least four members of the one-time council;

on the refusal to award the degree of Doctor of Philosophy, if it was supported by two or more members of the one-time council.

29. According to the results of the voting, a decision of the one-time council on awarding (refusal to award) the degree of Doctor of Philosophy is drawn up in the form approved by the Ministry of Education and Culture. The decision, which is signed by the chairman of the one-time council and sealed with an impression of the institution's seal, necessarily indicates the results of the voting of the members of the one-time council.

A member of the one-time council has the right to express a separate opinion in writing, in which to note remarks about the dissertation, in particular, regarding the applicant's observance of academic integrity and/or the procedure for defending the dissertation. A separate opinion is attached to the decision of the one-time council on awarding (refusal to award) the degree of Doctor of Philosophy and is an integral part of it.

An integral part of the decision is also a video recording of the dissertation defense broadcast, on which the institution's electronic seal is superimposed, based on a qualified electronic seal certificate.

30. The recipient has the right to withdraw the thesis from the defense before the start of voting on the awarding of the degree of Doctor of Philosophy by a written application addressed to the chairman of the one-time council, except in cases where the one-time council detects a violation of academic integrity in the dissertation and/or scientific publications, which highlight the main scientific results theses. The acquirer can use this right only once.

If the one-time council has discovered facts of academic plagiarism, fabrication or falsification in the dissertation and/or scientific publications, which highlight the main scientific results of the dissertation, the application to withdraw the dissertation from the defense will not be accepted. In this case, the one-time council makes a decision to refuse to award the degree of Doctor of Philosophy without the right to re-submit the thesis for defense.

31. After the one-time council makes a decision to award (refusal to award) the degree of Doctor of Philosophy, the institution:

1) within three working days, publishes the decision of the one-time board on awarding (refusal to award) the degree of Doctor of Philosophy and a video recording of the broadcast of the dissertation defense on its official website, taking into account the requirements of the legislation on state secrets and official information. If the institution cannot publish a video recording of the dissertation defense broadcast on its official website, it shall publish a video recording of the dissertation defense broadcast on another website with the possibility of free viewing and mandatory publication of the link on its official website;

2) submits information about the results of the dissertation defense to the information system within five working days.

In the case of withdrawal of the dissertation from defense, the institution publishes information about this on its official website within three working days from the date of the defense of the dissertation, and also submits it to the information system.

32. In the event that the applicant withdraws the dissertation from the defense or the one-time board refuses to award the degree of Doctor of Philosophy, the applicant has the right, subject to revisions, to resubmit the dissertation for defense no earlier than one year later, except for the case provided for in the second paragraph of Clause 30 of this Procedure.

Re-defense of the dissertation after its finalization is possible on the condition that the applicant receives a second opinion on the scientific novelty, theoretical and practical significance of the results of the dissertation.

33. Based on the decision of the one-time council on awarding the degree of Doctor of Philosophy, the institution shall issue an order not earlier than 15 and no later than 30 calendar days after the day of the defense of the thesis to issue the recipient a diploma of Doctor of Philosophy and an appendix to it of the European model.

If, within 15 calendar days from the date of the dissertation defense, the institution has detected a violation of the dissertation defense procedure established by this Order, or the institution has been notified of such a violation, the institution's order to issue the recipient of the Doctor of Philosophy diploma is issued in the event that the academic council makes a decision to leave the decision of the one-time council in force .

The decision of the one-time council on awarding the degree of Doctor of Philosophy enters into force from the date of entry into force of the order of the institution on issuing the diploma of Doctor of Philosophy.

The diploma of the Doctor of Philosophy is drawn up according to the form approved by the Ministry of Education and Culture and is issued to the recipient in accordance with the procedure established by the institution.

The candidate whose training was carried out in accordance with the agreement between domestic and foreign institutions and who was awarded the degree of Doctor of Philosophy in accordance with this Procedure, the diploma of Doctor of Philosophy may also be issued by a foreign institution in accordance with the legislation of the state where such an institution is located.

34. Within ten working days from the date of issuance of the Doctor of Philosophy diploma, the institution shall attach a copy of the decision of the one-time council on awarding the degree of Doctor of Philosophy, certified by the head of the one-time council, to the copy of the thesis kept in the library of the institution.

The provisions of this clause are applied taking into account the requirements of the legislation on state secrets and official information.

35. The conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation, reviews, feedback, the decision of the one-time board on awarding the degree of Doctor of Philosophy and the video recording of the broadcast of the dissertation defense are added to the recipient's personal file, which is kept in accordance with the law.

The video recording of the broadcast of the dissertation defense, made public by the institution, must be available for free viewing for at least six months from the date of entry into force of the decision of the one-time council on awarding the degree of Doctor of Philosophy.

Cancellation of the decision of the one-time council on awarding
the degree of Doctor of Philosophy in connection with the violation of the dissertation defense procedure

36. The institution that formed the one-time council has the right to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the violation of the dissertation defense procedure established by this Order, before issuing the recipient of the Doctor of Philosophy diploma.

Violation of the requirements regarding the composition of the one-time council cannot be a reason to cancel the decision of the one-time council, if the work of such a council has not been stopped by the Ministry of Education and Culture.

37. A notification regarding the violation of the dissertation defense procedure established by this Order may be submitted to the institution by any person who is a subject of scientific and scientific and technical activity within 15 calendar days from the date of the dissertation defense. The notification shall include the surname and first name (for individuals) or full name (for legal entities) and address of the person, justification and reference to the evidence confirming the circumstances stated therein.

A notice of violation of the dissertation defense procedure is sent to:

in electronic form with an overlay of an electronic signature based on a qualified electronic signature certificate — to the institution's official e-mail address;

in paper form under the signature of the person who submits it (the head of the legal entity), to the address of the institution.

The date of submission of a notification regarding the violation of the dissertation defense procedure is the date of its receipt at the institution.

38. In order to consider the issue of canceling the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the violation of the dissertation defense procedure established by this Order, the academic council of the institution at the next meeting forms a commission consisting of three academic (scientific and pedagogical) employees of the institution. Members of the one-time council cannot be included in the composition of such a commission.

The commission considers reports regarding the violation of the dissertation defense procedure within two weeks from the date of its formation.

The results of the review are presented at the commission meeting, which is held openly, with the participation of the person who submitted the notification and/or his representative, the acquirer and, if necessary, members of the relevant one-time council. The specified persons are informed about the date, time and place of the meeting five calendar days before its date. The absence of the specified persons at the meeting does not prevent the consideration of the notification regarding the violation of the dissertation defense procedure.

39. Within five working days from the date of the meeting, the commission prepares a conclusion, which is signed by all members of the commission.

The commission's conclusion states the grounds for its decision and suggests:

cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the violation of the procedure for the defense of the dissertation established by this Order;

deny the person a notification regarding the violation of the dissertation defense procedure.

The commission's conclusion is submitted to the academic council of the institution within three working days from the date of signing.

The academic council of the institution at the next meeting considers the conclusion of the commission and, based on the results of its review, makes a decision to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy or to leave the decision of the one-time council in force, which is issued by an order of the institution.

Within three working days from the date of issuance of the specified order, the decision of the academic council together with the commission's conclusion is published on the institution's official website.

40. The National Agency has the right to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the violation of the procedure for the defense of the dissertation established by this Order within six months from the date of the institution's order to issue the recipient of the Doctor of Philosophy diploma.

If the National Agency receives a notification regarding the violation of the dissertation defense procedure, the National Agency will consider it within three months from the date of receipt.

41. A notification regarding the violation of the dissertation defense procedure can be submitted to the National Agency by any person who is the subject of scientific and scientific and technical activities. The notification shall include the surname and first name (for individuals) or full name (for legal entities) and address of the person, justification and reference to the evidence confirming the circumstances stated therein.

A notice of violation of the dissertation defense procedure is sent to:

in electronic form with an overlay of an electronic signature based on a qualified electronic signature certificate — to the official email address of the National Agency;

in paper form under the signature of the person submitting it (the head of the legal entity), to the address of the National Agency.

The date of submission of a notification regarding the violation of the dissertation defense procedure is the date of its receipt by the National Agency.

42. Within three working days from the date of receipt of the notification regarding the violation of the dissertation defense procedure, the national agency publishes it in the information system and sends a copy of it to the relevant institution.

In the case of non-compliance of the specified notification with the requirements established by the first to fourth paragraphs of Clause 41 of this Procedure, the National Agency returns the notification to the person without consideration.

Within 20 working days from the date of receipt of the notification regarding the violation of the dissertation defense procedure, the institution has the right to provide written explanations regarding the circumstances outlined in the notification. Failure to provide such explanations does not prevent consideration of the said notification.

The national agency has the right to receive from the institution the information and documents necessary to consider the notification.

43. A notice of violation of the dissertation defense procedure is considered by the Appeals Committee of the National Agency (hereinafter referred to as the Appeals Committee) in accordance with the procedure established by the National Agency.

The results of the consideration of the notification regarding the violation of the dissertation defense procedure are submitted to the meeting of the Appeals Committee. The person who submitted the notice and the institution are informed about the date, time and place of the meeting five working days before the date of the meeting. The participation of the specified person and the representative of the institution in the meeting of the Appeals Committee is not mandatory.

At its meeting, the appeals committee determines the presence or absence of violations of the dissertation defense procedure established by this Order, prepares a submission and submits it for consideration by the National Agency.

In the event that the Appeals Committee, during the consideration of a notification regarding the violation of the dissertation defense procedure, discovers violations of academic integrity, in particular, the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification, the Appeals Committee makes a decision to transfer the said notification for consideration by the Ethics Committee of the National Agency (hereinafter - the Ethics Committee) and enters information about it into the information system.

44. The date, time and place of the meeting of the National Agency for considering the submission of the Appeals Committee shall be notified to the person who submitted the notification regarding the violation of the dissertation defense procedure and the institution five working days before the date of the meeting. The participation of the specified person and the representative of the institution in the meeting of the National Agency is not mandatory.

Based on the results of the review, the National Agency at its meeting makes a decision to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy or to leave the decision of the one-time council in force.

Within five working days from the date of the meeting, the National Agency informs the person who submitted a notification regarding the violation of the dissertation defense procedure, the institution and the person whose dissertation was considered, about the decision made, and also enters the relevant information into the information system.

Cancellation of the decision of the one-time council on awarding
the degree of Doctor of Philosophy in connection with the establishment of factual academic plagiarism, fabrication, falsification

45. The institution in which the one-time council was formed, or its successor, has the right to cancel the decision of the one-time council to award the degree of Doctor of Philosophy in connection with the discovery in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication , falsification regardless of the period that has passed since the one-time council awarded the degree of Doctor of Philosophy.

The institution, within three months from the moment it discovers in the protected dissertation and/or scientific publications, which highlight the scientific results of the dissertation, the facts of academic plagiarism, fabrication, falsification, or from the day the institution receives a notification of the said facts, considers the issue of canceling the decision of the one-time awarding council degree of Doctor of Philosophy.

Any person who is a subject of scientific and scientific-technical activity may submit a notification regarding the presence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation. The notification shall include the surname and first name (for individuals) or full name (for legal entities) and address of the person, justification and reference to the evidence confirming the circumstances stated therein.

The notification regarding the presence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, is sent to:

in electronic form with an overlay of an electronic signature based on a qualified electronic signature certificate — to the institution's official e-mail address;

in paper form under the signature of the person who submits it (the head of the legal entity), to the address of the institution.

The date of submission of the notification regarding the presence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, is the date of its receipt at the institution.

46. The procedure for establishing the facts of violation of academic integrity and canceling the decision of the one-time council is determined by the academic council of the institution, taking into account the requirements of the Law of Ukraine "On Education", special laws and this Procedure.

The issue of revoking the decision of the one-time board on awarding the degree of Doctor of Philosophy in connection with the discovery of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, is submitted to the meeting of the academic board of the institution. The date, time and place of the meeting of the academic council are informed to the person who submitted the notice, the person whose decision on the award of the degree of Doctor of Philosophy is being appealed, and, if necessary, the members of the relevant one-time council five working days before the date of the meeting. At its meeting, the academic council makes a decision to cancel the decision of the one-time council on awarding the degree of doctor of philosophy or to leave the decision of the one-time council in force.

47. The National Agency considers the issue of revoking the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the discovery of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, in the event of:

1) receipt of a person's complaint to the National Agency about the institution's decision to leave without consideration its notification regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, facts of academic plagiarism, fabrication, falsification or to leave the decision of the one-time board in force ( further - a complaint);

2) notification to the National Agency regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification in the event of the liquidation of the institution, the one-time board of which made the relevant decision;

3) transfer by the Appeals Committee for consideration by the Ethics Committee of a notice regarding the violation of the dissertation defense procedure, during the examination of which violations of academic integrity were detected, in particular, the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification .

48. A complaint/notification regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification can be submitted to the National Agency by any person who is the subject of scientific and scientific and technical activity The complaint/message shall include the surname and first name (for individuals) or full name (for legal entities) and the address of the person, justification and reference to the evidence confirming the circumstances stated in them.

Complaints/notifications regarding the presence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, should be sent to:

in electronic form with an overlay of an electronic signature based on a qualified electronic signature certificate — to the official email address of the National Agency;

in paper form under the signature of the person submitting it (the head of the legal entity), to the address of the National Agency.

The date of submission of a complaint/notification regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification is the date of receipt of the complaint/notification to the National Agency.

Within three working days from the date of receipt of the complaint/notification, the National Agency publishes them in the information system, and also sends a copy of the complaint to the institution whose one-time board made the relevant decision.

If the complaint/notification does not meet the requirements specified in this paragraph, the National Agency returns the complaint/notification to the person without consideration.

The Ethics Committee within three working days from the date of receiving from the Appeals Committee a notification regarding the violation of the dissertation defense procedure, during the review of which violations of academic integrity were detected, in particular the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification, sends a copy of the materials related to the detected violations to the institution, whose one-time board made the relevant decision.

49. Complaints/notifications regarding the presence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, are considered by the Ethics Committee in accordance with the procedure established by the National Agency.

The results of consideration of the complaint/notification regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, facts of academic plagiarism, fabrication, falsification, as well as materials related to violations of academic integrity identified by the Appeals Committee, are submitted to the meeting of the Ethics Committee. The person who submitted the complaint/notification and the institution are informed about the date, time and place of the meeting five working days before the date of the meeting. The participation of the specified person and the representative of the institution in the meeting of the Ethics Committee is not mandatory.

At its meeting, the Ethics Committee establishes the presence or absence of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, and prepares a report about it and submits it to the National Agency for consideration.

50. The date, time and place of the meeting of the National Agency for consideration of the submission to the Committee on Ethics shall be informed by the person who submitted the complaint/notification regarding the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification , and institution five working days before the date of the meeting. The participation of the specified person and the representative of the institution in the meeting of the National Agency is not mandatory.

Based on the results of the review, the National Agency at its meeting decides to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy in connection with the discovery in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification or about leaving the decision of the one-time board in force.

Within five working days from the date of the meeting, the National Agency informs the person who filed a complaint/notification about the presence in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, of facts of academic plagiarism, fabrication, falsification, the institution and the person , in relation to the dissertation of which the complaint/message was considered, and also enters the relevant information into the information system.

Legal consequences of annulment of the decision of the one-time board

51. In case of annulment of the decision of the one-time council on awarding the degree of Doctor of Philosophy after issuing the diploma of Doctor of Philosophy to the recipient, such diploma is considered invalid from the date of adoption of the relevant decision.

Within three working days from the date of the institution/National Agency's decision to cancel the decision of the one-time council on awarding the degree of Doctor of Philosophy, information about the invalidity of the diploma of Doctor of Philosophy is entered by them into the Unified State Electronic Database on Education.

52. In the case of cancellation of the decision of the one-time council in connection with the violation of the procedure for the defense of the dissertation established by this Order, the applicant has the right to submit the dissertation on the same topic for defense again.

In the case of cancellation of the decision of the one-time council in connection with the discovery of facts of academic plagiarism, fabrication, falsification in the dissertation and/or scientific publications, which highlight the scientific results of the dissertation, the dissertation shall not be submitted for defense again.

Financial and organizational support
of the applicant's attestation

53. Expenses related to the attestation of the acquirer, including the payment of the work of official opponents, are carried out by the institution in which the one-time council is formed, at the expense of the sources from which the preparation of the acquirer is (was) carried out or at the expense of the institution's funds. The institution must provide in its budget for the expenses related to the attestation of the applicant, including within six months after his/her withdrawal from postgraduate studies or the end of the term of his/her attachment.

In the event that the applicant applies to the institution to obtain a conclusion on the scientific novelty, theoretical and practical significance of the results of the dissertation and/or the defense of the dissertation six months after being expelled from postgraduate studies or the end of the attachment period (taking into account paragraph 12 of this Procedure) or re-submission of the dissertation for defense and passing the attestation, expenses related to the attestation of the acquirer are carried out by him at the expense of his own funds or the funds of individuals and legal entities.

54. The institution credits the chairman of the one-time council and reviewers for the performance of their functions during one dissertation defense at least 32 hours within the time norms of scientific work established by the institution for scientific and pedagogical workers (within the main workload - for scientific workers).

The institution in which the one-time council is formed pays for the work of official opponents for the performance of functions related to the attestation of the applicant during one dissertation defense in accordance with the norms of hourly wages for persons who have the scientific degrees of Doctor of Sciences, Doctor of Philosophy (Candidate of Sciences) and conduct training sessions with post-graduate students provided for by the Resolution of the Cabinet of Ministers of Ukraine of August 30, 2002 No. 1298 "On remuneration of employees based on the Unified tariff grid of grades and coefficients for remuneration of employees of institutions, establishments and organizations of certain branches of the budget sphere" (Official Gazette of Ukraine , 2002, No. 36, Article 1699), at the rate of 12 hours, from January 1,
2023 - 24 hours, from January 1, 2024 - 32 hours. If the estimate of the institution does not provide for expenses related to the attestation of the applicant, the provisions of this paragraph do not apply.

55. The applicant, his scientific supervisor (scientific supervisors) are prohibited before, during and/or after the defense of the dissertation from providing or offering to provide members of the one-time council, the head and other officials of the institution in which the one-time council is formed, any material and/or intangible benefits, in particular funds or any other property, payment for food services, transportation, accommodation of such persons.

56. Support for the activities of one-time councils is carried out by the postgraduate department (adjunct faculty) or another structural unit or official designated by the institution.

57. The institution submits the information stipulated by this Procedure to the National Agency through the information system in the form of documents in electronic form, generated by means of the information system, on which the electronic signature of an authorized official of the institution is superimposed, based on a qualified electronic signature certificate.
